At Avize, we understand the devastating impacts an injury can have on every aspect of your life. In Matthews v. Langford, our team demanded fair compensation for our brain-injured client by proceeding to a jury trial in the face of several unacceptable settlement offers by the defendant.

Background of the Case

Our client, Ms. Matthews, spent her entire life working hard to support herself and her son. When she was seriously injured at a hockey game by an errant puck that flew through a torn net that the defendants had failed to inspect and maintain, her entire life changed forever. Despite her significant limitations and her inability to work, the defendants refused to offer her fair compensation.

Over $1 Million in Damages Awarded

Armed with knowledge that juries can be unpredictable, we knew we had to present complicated evidence persuasively and clearly. By strategically deploying and adducing expert opinions, skillfully explaining complex economic evidence, and presenting our case effectively, we secured over 1 million dollars in damages for Ms. Matthews and over $800,000 in compensation for her earning losses, even though she was over the age of 65.

The defendants appealed the 1 million dollar award, arguing that the amount was disproportionately high and not supported by evidence. The BC Court of Appeal unanimously rejected the appeal, ruling instead that the award was reasonable and well-supported by the evidence we adduced at trial.
